End-User License Agreement (EULA) for Concrete

Introduction

This End-User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and Concrete for the Concrete application software, which includes computer software and may include associated media, printed materials, and online or electronic documentation ("App").

By installing, copying, or otherwise using the App, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the App.

1. Acknowledgement

You acknowledge that this EULA is concluded between you and Concrete, and not with any third-party app store provider. Concrete, not the app store provider, is solely responsible for the App and its content.

2. Scope of License

This EULA grants you a non-transferable license to use the App on devices that you own or control and as permitted by the terms and conditions of the app store from which you downloaded the App.

3. Objectionable Content

You agree not to use the App to upload, post, or otherwise transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.

4. Prohibition of Abusive Behavior

Users of Concrete are strictly prohibited from engaging in any form of abusive behavior. This includes, but is not limited to, harassment, bullying, stalking, or any other conduct that is intended to threaten, intimidate, or coerce other users. Any reports of abusive behavior will be taken seriously and may result in immediate suspension or termination of the user's account and legal action, if necessary.

5. Restrictions on Misuse of Location Data

In accordance with the commitment of Concrete to uphold the privacy and security of its users, the use of location-based services provided by the App for tracking, monitoring, or otherwise infringing upon the privacy and autonomy of other individuals is strictly prohibited. Users are expressly forbidden from utilizing any location data accessible through the App to engage in stalking, surveillance, or any form of unsolicited or harassing behavior. Violation of this policy constitutes a serious breach of this Agreement and will result in immediate account suspension or termination, and may subject the violator to legal action and reporting to law enforcement authorities as deemed appropriate.

6. Maintenance and Support

Concrete is solely responsible for providing any maintenance and support services for the App, as specified in this EULA or as required under applicable law. The third-party app store provider has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

7. Warranty

Concrete provides the App "as is" and with all faults. No warranty is given that the App will be error-free or uninterrupted, or that any defects will be corrected. Concrete disclaims all warranties, whether express or implied, including without limitation any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Product Claims

Concrete, not the app store provider, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App.

9. Intellectual Property Rights

You acknowledge that, in the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, Concrete, not the app store provider, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

10. Legal Compliance

You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

11. Termination

This EULA is effective until terminated by you or Concrete. Your rights under this EULA will terminate automatically without notice from Concrete if you fail to comply with any term(s) of this EULA.

12. Governing Law

This EULA shall be governed by the laws of the United States of America excluding its conflicts of law rules.
